Terms & Conditions of Training Engagement

These Terms & Conditions govern all training services provided by One Percent Academy Sdn. Bhd. By registering for our training programs, the client agrees to comply with the terms outlined below.

  1. TRAINING INCLUSIONS

All confirmed training programs provided by One Percent Academy Sdn. Bhd. will include:

  • Official course materials (in digital or printed form).
  • E-Certificate of Completion for participants who fulfill the attendance and participation requirements.
  1. COURSE CONFIRMATION
  • Training confirmation must be made through the issuance of a Purchase Order (PO) and/or signing the official quotation issued by One Percent Academy Sdn. Bhd.
  • By signing the registration form or quotation, the client acknowledges and accepts all terms and conditions herein.
  • Full payment must be made to: ONE PERCENT ACADEMY SDN. BHD.
  • Payment should be made at least 10 working days before the scheduled training date unless otherwise agreed.
  • For HRD Corp Claimable Courses, clients are responsible for ensuring claim approval. If claims are not approved, the client shall be liable to cover the full training fee.
  1. CANCELLATION POLICY

All cancellations must be communicated in writing. The following charges apply:

  • More than 10 working days’ notice: No cancellation fee.
  • 6 to 10 working days’ notice: 50% of the total training fee will be charged.
  • Less than 6 working days’ notice: 100% of the total training fee will be charged.

No refund will be given for participants who fail to attend without notice.

  1. POSTPONEMENT POLICY

Written notice is required for any request to postpone a confirmed training. The following charges apply:

  • More than 10 working days’ notice: No penalty.
  • 6 to 10 working days’ notice: 25% of the total training fee will be charged.
  • Less than 6 working days’ notice: 50% of the total training fee will be charged.

Postponement requests must include a proposed rescheduled date within 180 days of the original training date.

  1. REPLACEMENT OF PARTICIPANTS

Participant replacement is allowed at no extra cost provided:

  • Written notice is given at least 3 working days before the training.
  • Replacement participants meet the course prerequisites, if any.
  1. TRAINING LOCATION & FACILITIES
  • For onsite training conducted at the client’s premises, the client is responsible for providing a suitable training venue, projector, whiteboard, and markers unless otherwise stated.
  • For virtual training, participants must have access to stable internet and relevant devices.
  1. CERTIFICATES

Certificates of Completion will only be issued to:

  • Participants who have achieved at least 90% attendance, and
  • Completed the required course activities or assessments.
  1. INTELLECTUAL PROPERTY
  • All training materials are the intellectual property of One Percent Academy Sdn. Bhd. or its trainers.
  • No part of the training content may be reproduced, shared, or distributed without written permission.
  1. TRAINER SUBSTITUTION
  • One Percent Academy Sdn. Bhd. reserves the right to substitute a trainer due to illness, emergency, or unforeseen circumstances.
  • All substitute trainers will be equally qualified and briefed to deliver the content effectively.
  1. LIMITATION OF LIABILITY
  • One Percent Academy Sdn. Bhd. shall not be held liable for any loss or damages arising directly or indirectly from the training, including but not limited to financial loss or disruption to business operations.
  1. FORCE MAJEURE

We shall not be liable for any delay or failure to deliver the training due to circumstances beyond our control, including but not limited to natural disasters, government restrictions, or pandemics.

  1. DISPUTE RESOLUTION

Any disputes arising out of or in connection with this agreement shall be resolved amicably. Failing which, the matter shall be referred to arbitration in accordance with Malaysian law.

  1. TRAINING QUALITY COMMITMENT & SATISFACTION GUARANTEE

At One Percent Academy, we are committed to delivering high-quality, results-driven training. If the expected results are not met, we will conduct a review and offer:

  • A 50% refund of the training fee (excluding venue, meals, accommodation, and third-party costs), or
  • A make-up session or trainer replacement,

Subject to the following conditions:

This Satisfaction Guarantee is only valid if all the following criteria are met:

  1. Training objectives were clearly documented and agreed upon in writing before the program (e.g., via signed proposal or kickoff form).
  2. Participants attended at least 90% of the training and completed all required course activities.
  3. A formal feedback and refund request is submitted within 10 working days of the training end date.
  4. One Percent Academy reserves the right to review all participant feedback and assess trainer performance logs or recordings if available.
  5. This guarantee excludes dissatisfaction arising from factors beyond our control, such as:
    • Client-provided venue issues
    • Poor participant attitude or lack of engagement
    • Sudden change of expectations after training delivery

One Percent Academy reserves the right to decline refund claims that are subjective, unsubstantiated, or based on reasons unrelated to the actual training delivery.
